This Privacy Policy explains how Samantha Millen, trading as OpsClarity (ABN 57 606 469 183) (OpsClarity, we, us or our) collects, holds, uses and discloses personal information.

This Privacy Policy applies to our website, our online enquiry and booking tools, our email and business communications, and the services we provide. information about your business systems, website and marketing that you provide to us so that we can assess or perform our services;

through the third-party platforms we use to operate our website and manage enquiries and communications, including Webflow, HubSpot and Google Workspace; and

(d)

occasionally, from third parties such as a person who refers you to us, or from publicly available sources, where it is reasonable and practicable to do so.

The Clarity Check tool

7.1

We may offer an online Clarity Check, which is an interactive tool that uses artificial intelligence, including tools built on third-party platforms such as OpenAI's ChatGPT, to provide general guidance and suggest an appropriate starting point for our services.

7.2

Information you enter into the Clarity Check may be processed by the third-party platform that hosts the tool, and may be processed outside Australia. You should not enter sensitive information, confidential information, or the personal information of other people into the Clarity Check. We handle any personal information we receive through the tool in accordance with this Privacy Policy.

7.3

The Clarity Check provides general guidance only. It does not make any decision that has a legal or similarly significant effect on you, and further information about our use of artificial intelligence is set out in our AI Disclaimer.

Direct marketing

8.1

We may use your contact details to send you marketing communications about our services, such as newsletters, updates and offers, where you have consented or where we are otherwise permitted to do so under the Privacy Act and the Spam Act 2003 (Cth).

8.2

Every commercial electronic message we send will identify us and include a way to unsubscribe. You can opt out of marketing communications at any time by using the unsubscribe function or by contacting us using the details at the end of this Privacy Policy. We will action your request within a reasonable time.

Who we disclose personal information to

our personnel, contractors and subcontractors who need it to help us provide our services and run our business;

third-party service providers and platforms that support our website and operations, including website hosting (such as Webflow), customer relationship management, forms, bookings and email tools (such as HubSpot), productivity and email services (such as Google Workspace), website analytics and search optimisation tools, and providers of artificial intelligence tools;

professional advisers, such as our accountants and advisers, where reasonably necessary;

(d)

a purchaser or prospective purchaser of our business, subject to appropriate confidentiality arrangements; and

(e)

government agencies, regulators, courts and other parties where required or authorised by law.

We take reasonable steps to ensure that the third parties we engage handle personal information consistently with the Privacy Act.

Overseas disclosure

10.1

Some of the third-party platforms and service providers we use store or process information on servers located outside Australia, including in the United States and other countries. This means your personal information may be stored or processed overseas.

The countries in which our providers operate will depend on the provider and may change from time to time. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled in a manner consistent with the APPs.

Automated decisions and artificial intelligence

We use software, analytics and artificial intelligence tools to help us operate our website and deliver our services. Our AI Disclaimer explains how we use these tools.

We do not use these tools to make decisions that have a legal or similarly significant effect on you without human involvement. If this changes, we will update this Privacy Policy to reflect our obligations under the Privacy Act.

If we become aware of a data breach that is likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act.
